These Terms of Service (“Terms”) govern your access to and use of the Riseport platform provided by Riseport Pty Ltd (ABN 90 677 874 261) (“Riseport”, “we”, “us”, “our”). Please read them carefully.
By creating an account or using Riseport, you agree to these Terms. If you do not agree, you must not use Riseport.
1. Acceptance and eligibility
By accessing or using Riseport, you confirm that:
- you are at least 18 years old;
- you have the legal capacity to enter into these Terms; and
- if you are using Riseport on behalf of an entity, you are authorised to bind that entity, and “you” refers to that entity.
2. Description of the service
Riseport is a software-as-a-service (SaaS) platform for Australian residential-property investors and landlords. It allows you to:
- track properties, leases, transactions, valuations and documents;
- view portfolio insights such as equity, yield and cashflow;
- ingest and triage property-related email through the “Action Center”, which may suggest or draft actions; and
- view publicly-available macroeconomic information through “Market Pulse”.
Riseport is a productivity and information tool only. It does not provide financial product advice, tax advice or legal advice. See Section 9.
We may add, change, or remove features over time. Some features may be described on our roadmap and are not yet available; we do not commit to delivering roadmap features.
3. Subscription tiers and 30-day trial
Riseport is offered on the subscription tiers and prices set out on our pricing page. We offer a 30-day trial that does not require a credit card. Trial features and limits may differ from paid tiers.
At or before the end of the trial, you may choose to subscribe to a paid tier. If you do not subscribe, your access to paid features may end and your data may be subject to the retention terms in our Privacy Policy.
4. Accounts and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- provide accurate account information and keep it up to date;
- keep your login credentials secure; and
- notify us promptly at hello@riseport.co of any unauthorised use or security concern.
Authentication is handled via our authentication provider. You are responsible for compliance with their applicable terms as they relate to your login.
5. Subscription, billing, auto-renewal, cancellation and refunds
Billing. Paid subscriptions are billed through our payments provider, Stripe. By subscribing, you authorise us (via Stripe) to charge your nominated payment method the applicable fees for the subscription tier you select (see the subscription tiers and prices set out on our pricing page). Card details are handled by Stripe and are not stored by Riseport.
Auto-renewal. Paid subscriptions automatically renew at the end of each billing period (monthly or annually, as selected) at the then-current price, unless you cancel before the renewal date.
Price changes. We may change our fees. We will give you reasonable prior notice of any price change, which will take effect from your next billing period.
Cancellation. You may cancel your subscription at any time through your account settings or by contacting hello@riseport.co. Cancellation takes effect at the end of your current paid billing period, and you retain access to paid features until then.
GST. Prices are stated in Australian dollars. Riseport Pty Ltd is not registered for GST and does not charge GST on subscriptions. If Riseport becomes registered for GST in the future, subscription prices will be treated as inclusive of GST in accordance with the Australian Consumer Law, and any applicable GST amount will be shown at the point of purchase.
Refunds. A full refund is available if you cancel within 30 days of your first payment (whether on a monthly or an annual plan). After that 30-day period, cancelling stops your next renewal and you retain access until the end of your paid term, but we do not provide a partial-period or pro-rata refund for the remainder of that term. This refund policy is always subject to your non-excludable rights under the Australian Consumer Law (see the consumer-guarantees section, Section 12).
Your rights under the Australian Consumer Law. Nothing in this Section limits any rights or remedies you have under the Australian Consumer Law (ACL). Our services come with guarantees that cannot be excluded under the ACL. If we fail to meet a consumer guarantee, you may be entitled to a remedy (such as a refund) that we cannot contract out of. See Section 12.
6. Acceptable use and prohibited conduct
You agree not to:
- use Riseport for any unlawful, fraudulent or harmful purpose;
- upload or forward content you are not authorised to share, or that infringes another person’s rights;
- upload malware or attempt to gain unauthorised access to the platform or other users’ data;
- interfere with, disrupt, overload, or reverse-engineer the platform (except to the extent this restriction is prohibited by law);
- scrape, resell or commercially exploit the platform except as expressly permitted; or
- use the platform in a way that breaches any applicable law or the rights of any third party.
We may investigate and take appropriate action, including suspension or termination, for breaches of this Section.
7. User content and data
Your ownership. As between you and Riseport, you own the data and content you enter, upload or forward into Riseport (“Your Content”). These Terms do not transfer ownership of Your Content to us.
Licence to us. You grant Riseport a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display and process Your Content — including by automated means and AI/LLM processing — solely as needed to provide, maintain and secure the service for you. Riseport does not use Your Content (whether in identified, de-identified or aggregated form) to train or fine-tune AI/LLM models, or for other product-improvement purposes, and this licence authorises no such use. This position is reflected consistently in Sections 4 and 5 of the Privacy Policy.
Forwarded third-party email. When you forward email from third parties (such as agents, tenants, lenders or strata managers) into Riseport, you warrant that you are authorised to share that content with us and to have it processed as described in these Terms and our Privacy Policy. You are responsible for your handling of third parties’ personal information.
Your responsibility for accuracy. You are responsible for the accuracy, quality and legality of Your Content and for keeping your own backups where important to you.
8. AI features
Riseport uses automated processing, including artificial intelligence and large language models, to summarise documents and email and to suggest or draft actions.
You acknowledge and agree that:
- AI-generated outputs may be inaccurate, incomplete or out of date;
- you must independently review and verify any AI output before relying on or acting on it;
- AI outputs are provided for information and productivity purposes only and are not a substitute for professional advice; and
- Riseport is not liable for your reliance on AI outputs, to the extent permitted by law (subject to the non-excludable consumer guarantees in Section 12).
9. No financial, tax or legal advice
This is an important clause. Please read it carefully.
Riseport provides software and general information only. Riseport does not provide:
- financial product advice within the meaning of the Corporations Act 2001 (Cth). Nothing in the platform (including insights, calculations, Market Pulse information or AI suggestions) takes into account your objectives, financial situation or needs, and none of it is a recommendation to acquire, dispose of or hold any financial product;
- tax advice. Riseport is not a registered tax agent and does not provide tax agent services. Any tax-related features that may be added in future are informational tools only and do not constitute tax advice; or
- legal advice.
No credit advice or credit assistance. Riseport does not hold an Australian Credit Licence, is not a credit provider or a credit-assistance provider, and does not provide credit assistance or recommend, suggest or arrange any particular credit product or credit contract within the meaning of the National Consumer Credit Protection Act 2009 (Cth). Any loan-, mortgage- or finance-related figures shown in the platform (including balances, repayments, interest and equity calculations) are factual and informational only and are not a recommendation or suggestion to apply for, increase, refinance, vary or remain in any credit product.
AI suggestions. AI-generated suggestions and drafted actions are prompts for you to consider — not recommendations or opinions about any financial product, credit product or investment, and they do not take into account your objectives, financial situation or needs.
Riseport does not hold an Australian Financial Services Licence (AFSL) and is not authorised to provide financial product advice. Consistent with ASIC’s guidance on the provision of general information and factual tools, the platform provides factual information and general tools to help you organise and understand your own portfolio.
You must obtain your own advice from an appropriately licensed or registered professional (such as a licensed financial adviser, registered tax agent or accountant, or lawyer) before making any financial, tax, investment or legal decision. You are solely responsible for decisions you make using the platform.
See also our separate Disclaimer.
10. Intellectual property
Riseport, including the platform, its software, design, branding, and all related intellectual property, is owned by Riseport Pty Ltd or its licensors. Except for the rights expressly granted to you to use the service, no rights are transferred to you. You must not copy, modify, distribute, or create derivative works from the platform except as permitted by law or with our written consent.
11. Third-party services
Riseport integrates with third-party services (including Kinde, Stripe, Cloudflare and others). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services, and their availability or performance is outside our control. Market Pulse presents publicly-available third-party data (such as RBA and Treasury releases) for information only; we do not control, and are not responsible for, the accuracy or timeliness of that source data.
12. Disclaimers, warranties and the Australian Consumer Law
Australian Consumer Law guarantees. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value; and you are entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Otherwise, to the extent permitted by law, the platform is provided “as is” and “as available”, and we do not warrant that it will be uninterrupted, error-free, or that any insight, calculation or AI output will be accurate or complete.
13. Limitation of liability
To the maximum extent permitted by law, and subject to Section 12 (the non-excludable consumer guarantees):
- Riseport is not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of (or inability to use) the platform;
- our total aggregate liability arising out of or in connection with these Terms or the platform is limited to the total subscription fees paid by you to Riseport in the twelve (12) months immediately preceding the event giving rise to the liability;
- where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited (at our option) to re-supplying the service or paying the cost of re-supply.
14. Indemnity
To the extent permitted by law, you agree to indemnify Riseport against loss, damage, liability, costs and expenses that Riseport actually incurs in connection with a third-party claim to the extent that claim, and the loss, is caused by: (a) your breach of these Terms; (b) content you upload or forward that you were not authorised to share, or that infringes a third party’s rights; or (c) your unlawful use of the platform. This indemnity is limited to loss actually caused by the matters above and does not apply to the extent the loss was caused or contributed to by Riseport’s own breach, negligence or unlawful conduct. Nothing in this Section requires you to indemnify Riseport for liability that cannot lawfully be shifted to you, including under the Australian Consumer Law.
15. Termination and suspension
You may stop using Riseport and cancel your subscription at any time (see Section 5).
We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the platform or other users. We will give you notice before suspending or terminating your access, except where we are legally prevented from doing so or where immediate action is reasonably necessary to address a security risk, unlawful conduct or a risk of harm to the platform or other users; in those cases we will give notice as soon as we reasonably can.
On termination, your right to use the platform ends; provisions that by their nature should survive (including Sections 7, 9, 10, 12, 13 and 14) will survive. For a reasonable period after cancellation or termination, and before deletion under our Privacy Policy, we will give you a reasonable opportunity to export Your Content in a common format. Data handling after termination is described in our Privacy Policy.
16. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, and you and Riseport submit to the non-exclusive jurisdiction of the courts of that place. Before commencing proceedings, the parties agree to attempt in good faith to resolve any dispute by first contacting the other at hello@riseport.co. Nothing in this Section limits your rights under the Australian Consumer Law or your ability to lodge a complaint with a regulator.
17. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a revised effective date.
For material changes, we will give you reasonable prior notice (for example, by email or in-app notice) before the changes take effect, and you may cancel your subscription before that date if you do not accept them. Material changes will not take effect until the notice period has passed, and we will not rely on your continued use alone as acceptance of a material change.
For minor or non-material changes (such as clarifications or updates that do not adversely affect your rights), your continued use of Riseport after the revised Terms take effect constitutes acceptance.
Effective date: 7 July 2026
18. General
Severability. If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be read down to the minimum extent necessary or severed, and the remaining provisions will continue in full force.
Entire agreement. These Terms, together with our Privacy Policy and Disclaimer, form the entire agreement between you and Riseport in relation to the platform and supersede any prior understanding or agreement on that subject.
Waiver. A failure or delay by Riseport in exercising any right under these Terms is not a waiver of that right, and a single or partial exercise of a right does not prevent its further exercise.
Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Riseport may assign or novate these Terms, in whole or in part, including in connection with a sale, merger, restructure or transfer of its business or assets, provided your rights under these Terms are not materially reduced.
Force majeure. Riseport is not liable for any failure or delay in performing its obligations (other than payment or non-excludable obligations) to the extent caused by events beyond its reasonable control, including natural disasters, failures of third-party infrastructure or telecommunications, acts of government, or industrial action.
